VACANCIES – CIVIL SERVICE COMMISSION


PATENT AND DESIGN EXAMINER

Ministry of Commerce Industry and Trade

QUALIFICATIONS, SKILLS AND EXPERIENCE

  • Must have done and acquired O’Level certificate.
  • Bachelor’s Degree in Natural Sciences or any Engineering field from a recognized and accredited institution is a requirement.
  • Diploma in Law or Intellectual Property Law will be an added advantage.
  • Two (2) years post qualification experience in intellectual property will be an added advantage.
  • Computer Literacy.
  • Upright character and high integrity.

DUTIES/RESPONSIBILITIES

  • To examine applications for patents, industrial designs, utility models and integrated circuits from a technical standpoint to determine conformity to registration requirements according to the Patents Act.
  • To apply legal tests and principles to ensure industrial property is registrable.
  • To handle Patents Act related post examination actions.
  • To conduct prior art search to clients to ensure that an invention is new and non-obvious.
  • To undertake manual and online searches of previous publication to establish that inventions are novel.
  • To consider technical and legal matters affecting acceptability and entitlement to monopoly claimed by applicants.
  • To publish findings and technical reports on patentability for investors and patent practitioners.
  • To contribute to the compilation of the industrial property journal and publish applications together with search results.
  • To liaise with applications and agents to resolve disputed matters.
  • To assist in follow through on reviews and appeals to document their conclusion, including court hearings.
  • To ensure adherence to quality standards of data in the Industrial Property system.
  • To stay abreast with research to stay current with best practice.
  • To anticipate and address problems as related to industrial property rights.
  • To apply technical skills to deal with new problems and provide technical analysis and data to guide decision making and share expertise.
  • To use advanced functionalities to resolve problems, queries and reports in one system or moderate functionalities in more than one system.
  • To ensure appropriate changes are made to resolve client concerns.

SALARY

The basic salary is on Grade C4: E212,912 rising to E239,634 per annum.


COPYRIGHT EXAMINER

Ministry of Commerce Industry and Trade

QUALIFICATIONS, SKILLS AND EXPERIENCE

  • Bachelor’s Degree in Law (LLB) or BCom-Law or BA-Law is a requirement.
  • Diploma in Intellectual Property Law will be an added advantage.
  • Experience in Intellectual Property Law will be an added advantage.
  • Two (2) years post qualification experience in intellectual property will also be an added advantage.
  • Computer Literacy.
  • Upright character and high integrity.

DUTIES/RESPONSIBILITIES

  • To examine applications for accreditation by producers, right owners and importers of audio-visuals works and to determine conformity and issue certificates of accreditation.
  • To keep up-to-date records of accredited producers, rights owners and importers of sound and audio-visual works.
  • To process copyright applications from local, regional and international voluntary registration instruments.
  • To maintain IPAS or other systems to ensure that smooth flow of reception and other related works.
  • To distribute and affix the security device on audio-visual works entering channels of commerce.
  • To receive and keep records of books and quarterly inventory returns on the security device submitted by accredited producers, importers and owners of sound and audio-visual works.
  • To record copyright works published in Eswatini and issue recordation certificates.
  • To populate and keep an up-to-date database on the security device.
  • To maintain an up-to-date database of works, accredited producers, importers and rights holders.
  • To disseminate information about copyright and neighboring rights.
  • To resolve client queries on copyright marks, geographical indications, traditional knowledge, trade secrets and patents registries.
  • To participate in enforcement and awareness raising activities of IPO.
  • To handle basic client interaction, with focus on understanding, focusing and meeting customer needs and expectations.

SALARY

The basic salary is on Grade C4: E212,912 rising to E239,634 per annum.


TRADEMARKS EXAMINER

QUALIFICATIONS, SKILLS AND EXPERIENCE

  • Bachelor’s Degree in Law (LLB) is a requirement.
  • Diploma in Intellectual Property Law will be an added advantage.
  • Two (2) years post qualification experience in intellectual property will also be an added advantage.
  • Computer Literacy.
  • Upright character and high integrity.

DUTIES/RESPONSIBILITIES

  • To examine trademarks and marks applications to determine conformity to registration requirements according to the Trademarks Act.
  • To conduct pre-application searches using both internal and external resources.
  • To search the Eswatini, Regional and International Trade Marks Register databases.
  • To analyse information gathered to determine the registrability of trade marks, considering the legislative requirements.
  • To communicate with applicants and agents on the outcome of examinations and consider and respond to any submissions.
  • To recommend for acceptance or rejection of applications for the registration of trademarks.
  • To compose formal documentation, including reports detailing matters preventing registration of trade marks.
  • To assist in the handling of all required post examination actions.
  • To contribute to the compilation of the Industrial Property journal.
  • To ensure adherence to quality standards of data in the Trademark’s system.
  • To stay abreast with research to stay current with best practice.
  • To anticipate and address problems as related to own trademarks.
  • To apply technical skills to deal with new problems and provide technical analysis to guide decision making and share expertise.
  • To use advanced functionalities to resolve problems, queries and reports in one system or moderate functionalities in more than one system.
  • To ensure appropriate changes are made to resolve client concerns.

Hand deliver your application letter together with your Curriculum Vitae and certified copies of Tertiary Certificates to the Executive Secretary, Civil Service Commission. Foreign qualifications must be verified by the Eswatini Qualifications Authority (Education). Candidates who do not possess the above qualifications should not apply as their applications will not be considered.
