PATENT AND DESIGN EXAMINER
The Ministry of Commerce, Industry and Trade invites applications from suitably qualified candidates to fill the position of Patent and Design Examiner.
Qualifications, Skills and Experience
- O’Level Certificate or equivalent.
- Bachelor’s Degree in Natural Sciences or any Engineering field from a recognized and accredited institution (required).
- Diploma in Law or Intellectual Property Law (added advantage).
- At least two (2) years post-qualification experience in intellectual property (added advantage).
- Computer literacy.
- Demonstrated integrity and upright character.
Duties and Responsibilities
- Examine applications for patents, industrial designs, utility models, and integrated circuits to ensure compliance with the Patents Act.
- Apply legal principles to determine registrability of industrial property.
- Handle post-examination processes in line with the Patents Act.
- Conduct prior art searches to assess novelty and non-obviousness of inventions.
- Perform manual and electronic searches to verify originality.
- Assess technical and legal aspects affecting patentability and entitlement.
- Prepare technical reports and recommendations on patentability.
- Contribute to the compilation and publication of the Industrial Property Journal.
- Liaise with applicants and agents to resolve disputes.
- Support review and appeal processes, including court-related documentation.
- Maintain quality standards within the Industrial Property system.
- Stay updated with current research and best practices.
- Provide technical analysis to support decision-making.
- Utilize system functionalities to resolve queries and improve service delivery.
- Ensure effective resolution of client concerns.
Salary
Grade C4: E212,912 – E239,634 per annum.
COPYRIGHT EXAMINER

Qualifications, Skills and Experience
- Bachelor’s Degree in Law (LLB), BCom Law, or BA Law (required).
- Diploma in Intellectual Property Law (added advantage).
- Experience in Intellectual Property Law (added advantage).
- At least two (2) years post-qualification experience in intellectual property (added advantage).
- Computer literacy.
- Demonstrated integrity and upright character.
Duties and Responsibilities
- Examine applications for accreditation of producers, right holders, and importers of audio-visual works.
- Maintain updated records of accredited stakeholders.
- Process copyright applications at local, regional, and international levels.
- Manage IPAS or related systems to ensure efficient workflow.
- Oversee the application of security devices on audio-visual works.
- Maintain records of inventory returns submitted by accredited entities.
- Record copyright works published in Eswatini and issue certificates.
- Maintain up-to-date databases on works, rights holders, and security devices.
- Provide information on copyright and related rights.
- Address client queries related to intellectual property matters.
- Participate in enforcement and awareness initiatives.
- Deliver client-focused services aligned with customer needs.
Salary
Grade C4: E212,912 – E239,634 per annum.
TRADEMARKS EXAMINER

- Diploma in Intellectual Property Law (added advantage).

- Demonstrated integrity and upright character.
Duties and Responsibilities
- Examine trademark applications to ensure compliance with the Trademarks Act.
- Conduct pre-application searches using internal and external databases.
- Search national, regional, and international trademark registers.
- Assess registrability based on legal requirements.
- Communicate examination outcomes to applicants and agents.
- Recommend acceptance or rejection of trademark applications.
- Prepare formal reports and documentation for pre- and post-registration processes.
- Handle post-examination procedures.
- Contribute to the Industrial Property Journal.
- Maintain data quality within the Trademark system.
- Stay updated with research and best practices.
- Provide technical analysis and support decision-making.
- Utilize system functionalities to resolve operational challenges.
- Ensure effective resolution of client concerns.
Salary
Grade C4: E212,912 – E239,634 per annum.
